P & B Partitions, Inc.

P & B Partitions, Inc. a West Berlin, New Jersey contractor paid $18,000 in civil penalties and $51,422 in back wages after a Connecticut Department of Labor (DOL) investigation found it misclassified workers and failed to pay overtime properly.  The investigation found that P & B failed to pay weekly all monies due, didn't have complete or adequate wage records, did not have time records, failed to pay for all hours worked and failed to pay overtime properly.

P & B Partitions, Inc. also known as Tex-Mex Drywall and National Drywall has misclassified its employees as independent subcontractors to avoid paying Social Security taxes, unemployment insurance, and workers’ compensation insurance.  P&B has also cheated workers out of overtime pay, and provides little if anything in the way of health or retirement benefits.

Why would SM Wilson, LLC use such a subcontractor?  According to Rob Warner, project manager, to save $75,000.  You would think that Sunrise Senior Living, whose spending an estimated $9.4 million on their new facility in Lenexa, Kansas, and whose business is built on Seniors who can retire with dignity, would wish to see these workers be able to retire with dignity one day too!
