Q: What is Independent Contractor
Misclassification?
Employee misclassification occurs when an employer treats an employee as an
independent contractor in order to avoid paying social security, workers'
compensation, unemployment insurance, liability insurance and overtime.
Frequently this exploitation unfairly impacts immigrant workers.
It is illegal and constitutes tax and
insurance fraud!

"...The stories detailed how illegals working as
drywall tradesmen in and around Omaha - in some instances, working on the
area's most prestigious projects - become pawns in a system too large and
complex for them to fight. There is a paper trail certifying them as
independent contractors - and independent contractors are supposed to be
responsible for paying their own federal and state taxes. Among
illegal immigrants, it's a near certainty that most don't. The
system has evolved in such a way that an owner deals with a contractor who
deals with a subcontractor who deals with a go-between who deals with a
labor broker who deals with the workers." |
